Hur Ting Yang v. People of the Philippines, G.R. No. 195117, August 14, 2013 Commercial Law | Trust Receipts Supermax Philippines, Inc . is a domestic company engaged in the construction business , where petitioner Hur Tin Yang served as the Vice-President for Internal Affairs. Metropolitan Bank and Trust Company (Metrobank) extended several commercial letters of credit to Supermax to pay for construction materials used in their projects. Metrobank required Hur Tin Yang to sign twenty-four (24) trust receipts as security for these materials. Supermax failed to pay the loan or deliver the goods/proceeds upon demand. Metrobank filed criminal complaints for estafa under the Trust Receipts Law. Hur Tin Yang argued that the bank knew all along that the materials were for the company’s own construction business and were never intended for resale .
